These Terms & Conditions ('Terms') constitute a binding agreement between you and PivotHero governing your access to and use of the PivotHero platform, including the website, the free and paid reporting services, and any related features (collectively, the 'Service'). By creating an account or otherwise using the Service, you affirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to them, you should not access or use the Service.

What are PivotHero's terms of service for using the platform?

You may use the Service only for lawful purposes and only in a manner consistent with these Terms and our Acceptable Use Policy. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate registration information and keep it up to date. PivotHero reserves the right to refuse service, at its discretion, to any individual or organisation that it reasonably believes has provided false information or intends to misuse the Service.

Can I use PivotHero for my business spreadsheets and reports?

Yes. PivotHero is designed for exactly this purpose: uploading spreadsheet data — sales figures, inventory records, financial summaries, and comparable business data — so that the Service can generate pivot tables, charts, and summary reports on your behalf. You may use the Service for your own internal business purposes or on behalf of a client or employer, provided that you have the legal right to upload and process the underlying data in either case. You retain full ownership of the data you upload and of the reports generated from it; PivotHero claims no ownership interest in your content.

What data am I not permitted to upload?

You must not upload data that you do not have the legal right to process, that infringes the intellectual property or privacy rights of a third party, that is unlawful in your jurisdiction, or that contains malicious code intended to disrupt, damage, or gain unauthorised access to the Service or to other users. You must not attempt to circumvent upload validation, file-size limits, or the fair-use limits described in our Acceptable Use Policy. Violation of this section may result in the removal of the relevant content and, at PivotHero's discretion, suspension or termination of your account.

How does the US$10 per year Pro subscription work?

The free tier of PivotHero allows you to upload spreadsheets, receive AI-generated recommendations, and preview a watermarked version of your report at no cost. Upgrading to PivotHero Pro, currently priced at US$10 per year, removes the watermark and enables unlimited report generation and export to Excel, CSV, PDF, and PNG for a period of twelve months from the date of payment. Pro access is a single annual purchase rather than a recurring subscription: it does not renew automatically, and you will not be charged again unless you affirmatively choose to renew. Are PivotHero's AI-generated reports legally or financially reliable?

The recommendations, pivot tables, charts, and summaries produced by PivotHero are generated algorithmically from the data you provide and are intended to assist with, not replace, your own analysis and professional judgment. They do not constitute financial, accounting, legal, tax, or other professional advice, and PivotHero makes no representation that any report is complete, accurate, or fit for a particular purpose. You remain solely responsible for verifying any figure before relying on it for a business, financial, or legal decision. Additional detail is available in our Disclaimer.

Can PivotHero suspend or terminate my account?

PivotHero may suspend or terminate your account, with or without prior notice, if we reasonably believe you have violated these Terms, our Acceptable Use Policy, or applicable law, or if your use of the Service poses a security or operational risk to PivotHero or to other users. You may close your account at any time by contacting support@getpivothero.com. Termination does not entitle you to a refund of any amount already paid, except where required by our Refund Policy or by applicable law.

Who owns the PivotHero platform and its content?

The Service, including its software, design, branding, and all content that PivotHero itself creates (excluding the data you upload and the reports generated specifically for you), is the property of PivotHero and is protected by applicable intellectual property law. Nothing in these Terms grants you any right to use PivotHero's name, logo, or trademarks without prior written consent.

What is PivotHero's limitation of liability?

To the fullest extent permitted by applicable law, PivotHero and its officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of, or inability to use, the Service, even where PivotHero has been advised of the possibility of such damages. Where liability cannot be excluded under applicable law, PivotHero's total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you paid to PivotHero in the twelve months preceding the event giving rise to the claim.

Does PivotHero guarantee uninterrupted availability of the Service?

PivotHero takes reasonable steps to keep the Service available and operating correctly but does not guarantee that it will be uninterrupted, error-free, or available at all times. We may suspend access temporarily for maintenance, updates, or reasons beyond our reasonable control, including outages at our hosting or payment providers.

Which laws govern my agreement with PivotHero?

These Terms are governed by, and are to be construed in accordance with, the laws of [Governing Jurisdiction — to be confirmed by PivotHero], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of that jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.

What if part of these Terms is found unenforceable?

If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, Refund Policy, Acceptable Use Policy, and Disclaimer, constitute the entire agreement between you and PivotHero with respect to the Service and supersede any prior agreement on the same subject.

How will I know if these Terms change?

PivotHero may revise these Terms from time to time to reflect changes to the Service, legal or regulatory requirements, or our business practices. Where a change is material, we will make reasonable efforts to notify registered users, such as by email or an in-app notice, before it takes effect. Continued use of the Service after a revised version of these Terms takes effect constitutes acceptance of the revised Terms.
